MALICIOUS DOMESTIC ASSAULT ALLEGATIONS MADE BY EX

There are few situations that are messier than an acrimonious divorce where children are involved. In this case, the accused was charged with attacking her ex-husband and his new girlfriend with a baseball bat. This was, allegedly, witnessed by both of them. The client, however, indicated that their story was concocted due to a looming family court motion for custody and access to the children. This is, unfortunately, not terribly unusual. Many ex-spouses make up stories to better their positions in family court. The problem is proving it. In this case, there were two witnesses alleging that they had witnessed an event. After cross-examination of both Crown witnesses, it became apparent that the new girlfriend had been pressured into sticking with the story. The Crown withdrew the charges mid-trial.
