The average citizen is unaware of their legal rights. Many clients come to Mr. Lewandowski with an entrenched belief that since they were caught red handed that they have no options. This is incorrect. In this case, the client was charged with possession of over $120,000.00 of stolen prescription pills, including oxycontin, dilodid and other highly addictive opiate derivatives. The client was indeed caught red handed with the drugs in his knapsack, in the backseat where he was seated. Charges of this nature typically mandate penitentiary time of two years or more. The client, however, already had an advanced criminal record and thus the Crown position on a plea was for 5-7 years of custody. Upon review of the materials, it was clear that the police, did not adhere to the Charter in executing the arrest. Thus, a trial was set, and a Charter motion was filed, alleging an illegal search as well as excessive use of force. After a labored and tactical cross-examination of the arresting officers, the trial Judge excluded the seized drugs - the entire $120,000.00 haul. With no further evidence remaining, the charges were dismissed.
