Many people who appear before the Courts have experienced a tragic upbringing and are not the hardened criminals that the Crown attempts to paint them as. The full history of the accused is essential to ensure that the Judge imposing sentence is being given the full picture. In this case, the accused was arrested on drug possession charges and released to a residential treatment program. Although he was caught trafficking, it was obvious that he was trafficking for the purpose of fueling his own drug addiction. Thus, he went for rehabilitation while on bail. Despite his best efforts, he relapsed and was arrested for breaking and entering. Tragically, he was attempting to get money for his next drug fix. Upon this second arrest, he contacted Mr. Lewandowski. Despite an abhorrent record, Mr. Lewandowski was able to secure a bail release deal where he once again attempted treatment. Again, the accused relapsed, only this time, he was capture with approximately $30,000.00 worth of stolen pharmaceuticals. The Crown position was for 4 years in the penitentiary. After a heartfelt series of sentencing hearings, Mr. Lewandowski was able to reduce the time imposed to 18 months; this ensured that the accused would remain in the provincial jail system. It also allowed him to take part in the intensive drug treatment programs at the St. Lawrence Treatment Center.
